Board approves reduced front-yard setback and limited hillside disturbance for Petrovsky property (BA240034)

The Maricopa County Board of Adjustment approved variance requests for the Petrovsky property (case BA240034) on Jan. 16, allowing a reduced front-yard setback and a limited amount of hillside disturbance to accommodate a proposed residence, well and underground water storage tank.
Staff said the lot is classified as hillside and that the applicant proposes placing the home in the portion of the lot with the least steep slopes. Under the rural 190 zoning district the required front yard is 60 feet; the applicant requested a 50-foot front-yard setback measured from the access easement parallel to the northern property line. Staff also described a request to allow 1,438 square feet of hillside disturbance outside the principal building envelope for installation of a well, a water line and an underground storage tank; staff said disturbed areas would be returned to a natural state after underground construction is complete.
Martin (staff) summarized site constraints and explained the proposed locations would minimize hillside disturbance. Applicant representative Matt DeRosa said the ingress/egress easement interpretation relied on a prior board interpretation in case BA2005023 rather than an explicit reference in the zoning ordinance; he also said the well location was chosen to minimize new temporary access roads and to maintain a 100-foot setback between the well and the future home. DeRosa said moving the well inland would require more native-land disturbance to create drill access.
Vice Chair Person moved to approve BA240034 “subject to the language outlined in the staff report.” Member Clapp seconded. The board approved the motion by unanimous roll-call vote (Carden, Clapp, Ward, Person and Chairman Loper voting yes).
