The Modesto City Council on March 11 approved a sub‑trunk sewer reimbursement agreement with KB Home North Bay LLC for construction of the Sonoma Sewer Trunk Extension phases 3 and 4, constructed to serve the Tivoli specific plan area.
Public Works staff explained KB Home will proceed with construction of the sewer extension to better coordinate with on‑site construction, and the city will reimburse KB Home for the completed improvements. The agreement sets reimbursement after construction completion; details of reimbursement timing were presented in the staff report.
Members of the public asked whether a past advisory vote (Measure M) required voter approval for sewer extensions. Staff responded that the Tivoli specific plan area was annexed in February 2008 and previously subject to the vote and annexation, so the question is resolved for this area. Vice Mayor Bavaro confirmed the prior measure was an advisory vote and had been considered in planning for the area.
Councilmember Bavaro moved approval and Councilmember Wright seconded; the measure passed unanimously by roll call vote. The resolution authorizes the city manager or designee to execute the agreement.
The project is intended to extend sewer from Sylvan northward through the Tivoli plan area. Staff said the extension will serve most of the Tivoli specific plan area and will be reimbursed to KB Home following construction of the facilities.
