Council adopts rezoning for 189‑home planned development at Pelendale and American

The Modesto City Council on March 11 adopted Ordinance 3790‑CS, rezoning 22.6 acres at the northwest corner of Pelendale Avenue and American Avenue to Planned Development PD‑617 to accommodate a 189‑home single‑family subdivision.
The rezoning was presented by Jessica Hill, Director of Community and Economic Development, who said the planned development reduces typical city setbacks to allow smaller lots and would accommodate homes ranging from about 1,800 to 2,200 square feet. Hill said the city expects market prices to determine home values at time of sale and that streets within the development will be built as private streets, maintained by a homeowners association because they are not constructed to city standards.
Hill said the planned development zoning is intended to “assist in accommodating a new 189‑home single family development” and specifically allows decreased setbacks to fit smaller lots found elsewhere in the city. Resident Emerson Drake spoke at the public hearing, asking for approximate home sizes and price points and raising concerns about private streets, HOA requirements and whether smaller lots would result in very tall homes. Hill responded with the size range above and reiterated that the HOA is required because streets within the subdivision will not meet city standards and thus will remain private and be maintained by the HOA.
Councilmember Scooty Brayton moved final adoption of the ordinance; Councilmember Ricky seconded. The roll call vote was unanimous: Councilmember Alvarez, Councilmember Ricky, Vice Mayor Bavaro, Councilmember Williams, Councilmember Wright, Councilmember Scooty Brayton and Mayor Zwolens all voted aye. The motion carried and the ordinance was adopted.
Because the ordinance changes the zoning map (section 1‑3‑8), it will be codified in the city zoning map as PD‑617 and governing conditions will appear in the development agreement and will be enforced at permit and building‑plan review.
Staff noted the ordinance was a second reading on the council agenda; no amendments were proposed at the hearing and no additional conditions beyond those in the staff report were added.
The council action completes the rezoning step required before project permits and subdivision maps can be processed; subsequent approvals (subdivision map, improvement plans, building permits) will be required before construction begins.
