The Planning Board recommended that the City Commission approve a text amendment to extend the termination date of the Woodlands Overlay District until the code‑enforcement structure and an officer—funded under section 9 of the Woodlands development agreement—are established.
Senior planner Rob Johnson reviewed the overlay’s history: the Woodlands Overlay was adopted as part of the city’s land development code and its sunset date has been extended several times since 2018 because litigation and the COVID‑19 pandemic delayed redevelopment and the establishment of the enforcement mechanism. The Woodlands development agreement requires a code‑enforcement structure and funding mechanism (section 9) to support a dedicated enforcement officer who will implement the overlay standards.
Under the proposed amendment the overlay would remain in effect until the developer files building permits and the memorandum of understanding is finalized for the funded enforcement officer; staff said the expectation is the officer will be a City of Tamarac employee funded by the developer per the agreement. Board members asked timing questions; staff said the officer is expected to be in place once permits are filed and that the developer is prepared to proceed administratively.
The Planning Board voted 5‑0 to forward the text amendment to the City Commission for first and second readings.
