The Tamarac Planning Board on Wednesday recommended that the City Commission approve a text amendment to remove funeral homes as a permitted use from the Mixed Use Neighborhood and Mixed Use Corridor zoning districts.
Senior planner Anne Johnson said the change is intended to align permitted uses with the city’s 2040 comprehensive plan and economic development objectives for corridor redevelopment and to protect mixed‑use corridors targeted for retail, restaurants and pedestrian activity. City staff noted there have been multiple inquiries about funeral‑home locations, prompting a zoning‑in‑progress administrative order earlier in 2025 and a temporary resolution ratifying that order.
Under the proposed amendment, funeral homes would remain permitted in Business Park (BP) and Public Facilities districts but would no longer be allowed in the two mixed‑use districts. Johnson told the board there are three funeral homes located inside Tamarac and about 17 within five miles of the municipal borders; those existing in mixed‑use districts would be allowed to continue to operate as legally nonconforming uses provided they maintain their business licenses. If a funeral home attempts to relocate or a new funeral home seeks to open, the use would have to locate in a district that permits it under the revised code.
Board members asked about grandfathering and the scope of the zoning‑in‑progress; staff confirmed the amendment would be effective upon commission approval and that the zoning‑in‑progress had paused incoming funeral‑home applications while staff studied the appropriate districts. The Planning Board voted 5‑0 to forward the ordinance to the City Commission for first and second readings (June 11 and June 25, 2025 as scheduled in staff materials).
