County revises aviation policies to align with state limitations on land-use regulation of private airports

Consultants and staff explained that state law allows local governments to regulate land uses around public-use airports but does not grant the same authority over private-use airports. The draft red line replaces overly broad comp-plan language with wording that limits land-use restrictions to public-use airports, while adding a separate policy that allows the county to restrict construction and development activities that would create an airport hazard or obstruction for either public or private airports through other non-land-use development standards in the LDC.
Commissioners asked for more specificity about how "vicinity" would be defined in practice and whether approach zones or other tailored buffers should be referenced in the plan. Staff agreed the LDC is the appropriate place for detailed standards and said zoning regulations and proposed LDC language for airports and flying communities are under development. The board directed staff to cross-reference the LDC and to present proposed approach zones or clearer criteria for administrative review so the commission can evaluate the balance between safety protections and property-rights impacts.
No ordinances were adopted at the workshop; staff will return with LDC language and maps that define the airport approach zones and related restrictions for commission review.
