Council approves Chapter 380 amendment and consent-agreement exhibit for Willie Way extension

The Bee Cave City Council on March 11 unanimously approved changes to a Chapter 380 grant agreement and a related consent agreement with Kent Sports Holdings LP that alter stormwater-pond design and maintenance responsibilities for the proposed Willie Way extension.

Interim city engineer John Carlo Patino of Freese and Nichols presented the second amendment, which replaces prior language calling for a constructed wet pond with new language describing shallower dry biofiltration and water-quality ponds intended to serve as an amenity and to improve visual frontage along Highway 71. Under the amendment, maintenance responsibilities for the water-quality features shift from the city to the property owner, and several exhibits (Exhibit B replaced by B1 and B2) were updated to include plan views and renderings.

Why it matters: The amended design aims to spread storage across several shallower ponds with biofiltration rather than a single deep wet pond, which council members and staff said will be more visually appealing from 71 and could set precedent for future water-quality solutions.

Council discussion focused on improvements since a prior meeting. Council members and staff said concerns raised at an earlier hearing were addressed, and staff described opportunities for later irrigation sourcing (e.g., switching to gray water if system connections and approvals are available). The council also discussed coordination with the PUA and explored long-term sustainability of biofiltration features.

Formal action: A motion to approve the second amendment to the Chapter 380 agreement passed unanimously. A separate motion approving the amendment to the consent agreement (which updates exhibits to match the Chapter 380 amendment) also passed unanimously. The council did not record individual roll-call votes in the transcript; five members were present and voted in favor.

Implementation: Staff indicated the amendment will be reflected in updated exhibits and that later vertical construction submittals would include additional details. The project team said they have produced a 3D model for future presentations and will coordinate with utilities and park plans for irrigation options.

Public remarks: Council members thanked staff and the applicant for reworking plans on a short timetable and called the new design "a lot more visually appealing," visible from Highway 71 and better integrated with the Galleria frontage.
