A DeKalb County resident asked the Board of Commissioners on March 11 to cancel and reschedule two upcoming Zoning Board of Appeals (ZBA) meetings that he said were not legally advertised.
Mike Cooper, a former vice chairman of the District 4 Community Council, told the commission that the notices published in The Champion on Feb. 20 and March 6 failed to identify the Zoning Board of Appeals and therefore did not provide effective legal notice. Cooper cited “Section 7.2 0.4 d of the county's zoning code and section 36 66 4 of the Georgia code” as governing requirements and said the Feb. 20 notice gave less than 30 daysnotice for a meeting scheduled on March 12.
"Notices that do not mention the Zoning Board of Appeals cannot be considered legally effective notice of a ZBA meeting," Cooper said and asked the county to cancel the March 12 meeting and properly re-advertise it.
