County holds first hearing on Meritage Homes developer agreement amid traffic and flood concerns

Indian River County commissioners held the first of two required public hearings on March 11 over a proposed developer's agreement with Meritage Homes of Florida Inc. for a residential project on 40 Third Avenue Southwest that would be limited to 201 single-family lots and constructed in two phases.

The planning director, Chris Balter, told commissioners the project stems from entitlements and a traffic study originally prepared in 2004 for a previous, larger development; Meritage bought the site in 2021 and the applicant is seeking to codify a development agreement that sets the unit count and required public improvements. The board scheduled the second hearing for March 25.

Why it matters: Commissioners and many residents raised questions about transportation capacity on 40 Third Avenue SW and nearby Oslo Road, flood risk for new development mapped inside the special flood hazard area, and whether the county should rely on an older traffic study whose assumptions predated some current road-and-interchange plans. Those issues affect how and when Meritage's improvements would be required, and whether the development should proceed under the requested terms.
