Council approves rezoning at 1617 S. Kentucky to preserve single-family use

The Evansville Common Council voted to adopt Ordinance R2025.02 on Feb. 24, rezoning the property at 1617 South Kentucky Avenue from C-4 (commercial) to R-2 (residential) so the house can be used and financed as a single-family residence without the limitations that accompany legal nonconforming commercial zoning.
APC staff presented the request (Docket REZ-2025-002). The assessor’s records show the residence was built in 1919 and has been occupied as a home since that time, making the lot a legal nonconforming residential use within a primarily commercial corridor. The 2035 future land use map recommends commercial use for the corridor, but APC staff said the rezoning would be consistent with historical use of the property. APC recommended approval by an 8-0 vote.
Sarah Wibberly, representing the owner Dennis Gardner, told the council the property had been marketed as commercial without interest and that buyers seeking residential mortgages could not close while zoning remained commercial. “Most people interested in it were interested in using it as a home,” she said, and rezoning would remove the financing obstacle.
Following the APC recommendation, council voted by roll call. The clerk recorded eight ayes and zero nays; Councilman Hieronymus signaled assent by thumbs-up during roll call. The council declared Ordinance R2025.02 adopted.
