Klamath County transfers tax-foreclosed lot to City of Merrill after public hearing

The Klamath County Board of Commissioners held a public hearing Tuesday and voted to transfer a tax-foreclosed property at 13720 Lower Klamath Lake Road to the City of Merrill for municipal use.
County staff told the board the parcel, which the county obtained through tax foreclosure, has been used by the city for storage for years and sits adjacent to the former Merrill weed shop and the Merrill landfill. Rick Vaughn, Klamath County tax collector and property manager, said the city has used the lot informally "for storage of various equipment" during the eight years he has worked in the office.
Under the terms described in staff materials read into the record, the county may deed the property to the municipality pursuant to ORS 271.330 provided the city retains the property for a period of at least 20 years and uses it only for public purposes. The deed will include a reversionary clause that returns the property to the county if it is no longer used for a public purpose. The hearing notice was published in the local newspaper for two consecutive weeks as required by ORS 271.330.
Commissioner Minty moved to hold the public hearing and take testimony and consideration only; the board approved that motion and then moved to execute the order allowing transfer of parcel 41100150000200 to the City of Merrill. The board authorized the Klamath County property manager to sign the quitclaim deed on behalf of the county. The motion passed; the chair voted aye and the transfer was approved. The county will record a nominal revenue of $261.87 to cover publication and recording costs, reversed to the County Property Trust and Agency Fund.
The board recorded no public testimony during the hearing. Staff closed the hearing after announcing no members of the public had appeared to comment. The transfer proceeds subject to the recording of the deed and the reversionary clause that requires the property be retained for public use for the required period.
