The county attorney, T. C. Morphis, said discussions with attorneys for the parties indicate the board will likely need a special-called meeting to allow adequate hearing time for the quasi-judicial matter and to permit the appointment of a replacement commissioner to participate. Morphis said he had notified Catherine Lawrence, chair of the county Republican Party, and asked for a recommendation for a replacement for the vacancy created when commissioner Ellickson resigned; the county attorney said he would provide the recommendation to the board when it arrives.
Commissioners discussed accelerating the vacancy process and directed the county attorney to follow up with the party chair. The chairman and county attorney indicated the hearing had been continued to June 2 but that a special-called meeting was likely to accommodate the hearing schedule and the appointment process.
No formal action beyond declaration of recusal and instruction to staff was taken at the May 19 meeting.
