Senators asked whether cities that typically hire ABC officers in dense nightlife areas (for example Louisville’s Bardstown Road) usually have those officers POP‑certified; witnesses replied that in larger cities that is common practice.
The committee also discussed provisions appearing on pages 11 and 13 of the substitute regarding distilled-spirit and malt‑beverage licensees selling “by the drink” on Sunday. Senators sought confirmation whether the sub inadvertently expanded Sunday sales beyond existing separate Sunday licenses; witnesses said they would check and report back to the committee, and one sponsor said the sub was not intended to eliminate the separate Sunday license requirement.
Committee members said they would follow up with local ABC entities to ensure the measure would not unintentionally remove tools needed by ABC officers in cities with a high density of late‑night licenses. The committee adopted the substitute and passed House Bill 437 with a favorable report.
