Taneytown legal counsel advises council on ethics rules and campaign sign enforcement; nomination for ethics commission fails

During the March meeting Taneytown legal counsel reviewed the town’s ethics framework and the limits on enforcement of local sign regulations after questions from council members about a campaign sign in the downtown area and a candidate who is the mayor’s spouse.

The transcript records a legal briefing in which the counsel said the town’s ethics ordinance does not prohibit a person from running for office and described the mayor’s spouse as an "interested person" for financial-disclosure purposes under the ethics rules. Counsel advised that appointment powers of the mayor are generally not constrained solely because a relative is a candidate, but cautioned that the situation could create practical conflicts and would require careful handling.

Counsel also explained the town enforces sign size and placement rules without regard to content. He said the large downtown campaign sign in question appears to exceed the downtown zoning district’s square-footage limits and that enforcement would proceed as it does for other signs: an order from the zoning administrator and, if necessary, further action in court. Counsel suggested the council could discuss enforcement strategy and legal interpretations in closed session if they wished legal advice.

On nominations, the council considered Amanda Rankin for the Ethics Commission. Councilmembers moved to approve the nomination but the motion failed for lack of a second. Separately, a nomination for Bill Kennedy to continue service on the Board of Elections was withdrawn by the nominator and will be considered at a future meeting.

After the public meeting the council voted to adjourn to a closed session under Maryland Open Meetings Act Title 10, §3-305(b)(7) to obtain legal advice related to developers rights and responsibilities agreements.
