Commission approves final plat and a waiver to allow longer panhandle lot for O'Rear addition

The Frederick City Planning Commission unanimously approved a final subdivision plat for the O—9rear addition (Community Ventures LLC) and granted a modification permitting a residential panhandle up to 169.55 feet long, where the Land Management Code limits panhandle stems to 80 feet.
Staff said the plat consolidates land from an existing Lot 2 into a new Lot 1 to create a buildable parcel and an HOA-owned open space parcel. With the proposed lot line changes Lot 1 would increase from 52,392 square feet to 71,565 square feet, while Lot 2 would be reduced from 30,396 square feet to 11,210 square feet. Staff said Lot 2, the remainder, will meet minimum R-8 single-family detached standards and will retain Shookstown Road frontage via the panhandle; staff supported the panhandle modification because the existing improvements and lot configuration made strict adherence impracticable and the panhandle would remain at least 12 feet wide with adequate fire access.
The applicant s engineer, Luke Zeller of Harris & Regan Associates, said the transfer of land allows preservation of an existing playground and creation of an HOA-held open space to serve the new lots. The panhandle is an existing condition and an access easement currently serves the landlocked parcel; the requested modification creates fee-simple frontage for the remainder lot while enabling the HOA open space to be retained.
Commissioner Valencia moved approval of the modification; Commissioner Manelas seconded. The motion carried unanimously. Commissioners then approved the final plat finding it met applicable subdivision criteria and was consistent with the 2020 Comprehensive Plan. The commission s votes were recorded as unanimous for both actions.
