Council reviews petition to vacate alley beside Coral Sands RV Park; utilities clearances pending

Bluff Town Council reviewed a petition from Michael and Pamela Yaris asking the town to vacate one half of an alley adjacent to the Coral Sands RV Park and discussed outstanding utility responses, survey data and the public comment timeline.
Town staff reported Rocky Mountain Power informed the town that overhead power lines are not impacted by the requested alley abandonment and that the utility currently has no overhead lines in the alley portion under review. Staff said this response was the final utility clearance they had been awaiting.
Council members noted a pending issue with the legal description and survey for the specific portion of alley the Yaris petition referenced. Staff said the survey filed with the petition matched a quitclaim deed to Amrit and Cynthia Tomei but likely did not describe the alternate portion the Yaris family seeks to vacate. Councilors asked staff to request a separate survey or confirmation from the petitioners so the town can prepare an accurate deed description for recording if vacatur is approved.
Town staff also reminded members that written public comment on the petition is due by 6 p.m. Friday, Feb. 14, and that the council hoped to take the item to a vote at the Feb. 18 meeting provided outstanding materials arrive. Staff directed the applicant to submit any missing survey documents and said utility responses should use the town—s standard template form to ensure consistent information for future petitions.
Council discussed the petition—s hardship claim. According to the council—s summary of the public hearing, the Yaris applicants had reengineered a solar installation and asked for the vacatur to accommodate adjusted panel placement; councilors said they will review the record for whether construction began prior to the petition and how that timing should factor into the vacatur analysis.
No formal vote was taken at the Feb. 11 work session. Staff will notify the council when the petition packet is complete and confirmed whether the item will appear on Feb. 18 for a final decision.
