The Tuckahoe Zoning Board of Appeals granted area variances for work at 13 Harrison Street, allowing a finished attic bedroom and conversion of a detached garage to a home office and storage, while denying permission for a half bath in the garage.
The board found the applicant met the five-part variance test and determined the proposed improvements would not have an adverse impact on the surrounding neighborhood. The decision includes the condition that any work authorized by the variance must commence and be diligently prosecuted within one year of grant, or the variance will become null and void.
The application asked for relief from sections of the village zoning code identified in the record as 4-3.6 (area ratio), 5-1.6.3 (increasing a nonconformity) and 4-3.2 (height). The board's resolution noted that although a height variance was requested, the project will not increase the existing structure's height.
The applicant and project architect said two parking spaces are shown on the plans and that plumbing will be removed from the garage conversion; the garage will have electric only and no plumbing. The board specifically denied the request for the half bath in the converted garage but approved the other variances, stating the benefits to the applicant outweighed any detriment to health, safety and welfare of the neighborhood.
The motion passed by voice poll with all board members recorded in favor. The resolution reiterated that the action is an unlisted action under SEQRA and adopted a negative declaration based on the materials submitted.
Work under the variance must begin within one year of the grant to remain valid.
