The McMinnville Board of Zoning Appeals approved a resolution formalizing how it will give applicants written notice of their right to seek judicial review under a new state law that takes effect July 1.
The resolution places a short statement on the board’s adopted approval or denial resolution that informs the applicant they may appeal the board’s decision to the courts. “This new law will take effect in July 1,” said Sean (city staff), who presented draft resolution templates for approvals and denials and recommended using the resolution form so applicants receive the notice immediately after a vote.
City staff explained the practical benefits: the resolution can be signed at the meeting and provided to the applicant so they have written proof of the outcome without requiring an additional letter. Jerry (staff member) was identified as the person who would sign the resolution following the board vote.
Board members voted to adopt the approach. A motion to approve the resolution was made, seconded and—after the board’s voice vote of “aye”—the chair said, “Motion carries.” The board also discussed related changes to member training: staff noted an annual four-hour training requirement that must include property-rights content.
No changes to substantive zoning standards were adopted; the resolution documents the procedural notice required by the state law. Staff said further code edits will be processed to implement the statutory requirement in the city’s record-keeping and permitting workflow.
The board briefly discussed calendar logistics for July meetings and adjourned. The resolution provides the immediate written notice the new statute requires and is intended to streamline record-keeping for approvals and denials.
The board approved the resolution during the meeting and will provide the signed document to applicants at the time of action.
