Board rezones CVS corner on North Avenue from C-3 to C-2 to avoid nonconforming parcel

The Macomb Township Board of Trustees unanimously approved rezoning 5098 North Avenue from C-3 (general commercial) to C-2 (neighborhood commercial) at its May 14 meeting, a move staff said is intended to prevent a nonconforming parcel and align the corner with surrounding uses.
Mr. Van Tiflin, speaking for the Planning Department, said a prior contract rezoning placed a condition on the property that limited use to a drugstore and provided that the parcel would revert to C-3 if the drugstore stopped operating. That reversion, Van Tiflin said, would leave the roughly three-acre site nonconforming because the C-3 designation requires a minimum parcel size the property does not meet.
"We do know that Sheetz is interested in this corner," Supervisor Vivian said during the discussion, adding that the rezoning itself would not preclude a Sheetz development because either C-2 or C-3 could accommodate it. Van Tiflin and staff said the rezoning is largely a housekeeping move to avoid unintended, more intense C-3 uses on a parcel that is too small to meet C-3 lot-size requirements.
The Planning Commission recommended the rezoning unanimously at its prior meeting, and the Township Board approved the request without recorded dissent. Board members noted the corner has been commercial for decades and described the action as aligning zoning with the master plan and neighboring corners. The motion was moved by Treasurer's Law and supported by Trustee Oliver and recorded as passing unanimously.
