Code board finds Arbor Glen driveway in violation; fines set at $25 per day

The City of Winter Springs Code Enforcement Board on May 27 found the property at 1112 Arbor Glen Circle in violation of IPMC Section 302.3, the board's inspector said, and set a fine of $25 per day, accruing from Feb. 16, 2025, until the driveway defect is repaired.
Inspector Chris Alban told the board that respondents were previously ordered to fix the driveway after a Jan. 28, 2025, hearing and that reinspections on Feb. 18, March 5, April 15 and May 22 found the condition had not been fully corrected. Alban recommended the board impose the previously-ordered penalty for continued noncompliance.
The board heard from resident Jose Castro, who said he had been hospitalized in the period following the original order and that repair work was performed in March but that a crack had not been sealed because the materials needed to settle first. Castro told the board, "I have Alzheimer's and I haven't been working for a while," and said he had the materials in his garage and planned to seal the crack once the work settled.
Board members discussed the lapse in compliance and the proportion of any daily fine to the cost of the repair. After debate, a motion was approved that found the property remained in violation and reduced the previously‑ordered $150 daily penalty to $25 per day starting Feb. 16, 2025. The motion passed unanimously by roll call.
Board attorney Amelia Ulmer clarified that the fine would continue to accrue from Feb. 16 until the inspector confirms full repair, and that unpaid fines could be placed as a lien on the property.
The board gave Castro 30 days to complete and have the repair confirmed by the code inspector. If the inspector verifies compliance, the daily fines will stop; if not, fines will continue to accrue and may be recorded as a lien on the property.
