The Los Angeles City Council approved a settlement related to nuisance abatement conditions at a Studio City property operating as Aftershock after a public hearing and committee review.
Noel Weiss, speaking for the property owner, said the landlord was willing to evict a tenant if the city notified the owner of violations and to provide notice to future purchasers, but disputed the city requirement that the covenant run with the land. The judge in related litigation had previously expressed the view the covenant required by the city did not run with the land.
Councilmember Bernsen, summarizing the committee position, said the committee had unanimously rejected the offered settlement because the property owner refused to sign a covenant that would ensure compliance in perpetuity. “The use of the property that's permitted goes with the land and not with the tenant,” Bernsen said, and urged approval of the committee report.
The council voted on the file and approved the committee recommendation on a roll call (14 ayes).
Action recorded: committee report approved and the related settlement action carried as recommended by committee; council noted litigation remains pending and that the city would defend its nuisance abatement protocol if the owner declined to sign the covenant.
The council’s action preserves the city’s ability to pursue further court remedies if the property owner does not execute the covenant the council requested.
