Holmes County approved a set of easements with Pilot (the development entity) to allow utility installation and county access to a retention pond area tied to a development off Joe Manning Road. The agreements include a permanent utility easement for Dockery Holdings parcels and an access/ingress easement to reach the retention pond.
County legal staff said the easements give the county rights to enter the pond area if necessary but do not create a perpetual county obligation to maintain the pond. Earlier drafts had placed broader maintenance requirements on the county; final language assigns primary maintenance to the developer (Pilot) while preserving the county’s right to access and perform work if necessary.
The board approved the easements and directed the county attorney to finish final technical adjustments to signature blocks; staff said the documents are condition precedent to the developer’s closing and utility installation.
Ending: Staff will finalize ministerial edits, return final recorded easements to the clerk and coordinate with the developer and local utilities on next steps for water, sewer and power to the lift station.
