Council schedules public hearing for Crowther subdivision abandonment, developer seeks six-lot replat

Beaver City staff told the council on Jan. 13 that developer Kevin DeMille has purchased parcels associated with the Crowther (Traveler) subdivision, previously approved in 2022, and is seeking formal abandonment of that subdivision so he can record a new six‑lot plat.
Why it matters: the proposed change will adjust roads, utility easements and lot shapes near 885 North and in the vicinity of 500 East; staff said the developer has already secured planning and zoning approvals and that the development will extend sewer and water connections to the new lots at the developer’s cost.
Council discussion and next steps: staff explained that abandonment of a recorded subdivision requires ordinance action and a public hearing before the council. Council members and staff agreed to schedule the required public hearing and ordinance adoption for the first council meeting in February, with the intention of processing the abandonment and the new plat on the same night if legally permissible.
What the developer will pay for: according to staff, the developer will construct the private road (a hammerhead configuration approved by the fire marshal or a cul‑de‑sac at his choice), build all utility infrastructure where required, extend sewer service with a new manhole connection, install fire hydrant(s) at the end of the line, and provide necessary easements. The subdivision will include a private road and privately built utilities; staff said the developer will pave the road but could opt for gravel as a private driveway if desired.
Public hearing scheduling: staff said the required public hearing will be posted for the Feb. 2025 council meeting; staff will prepare the ordinance language and obtain a surveyor’s legal description (from the city’s surveyor) in advance.
