Council authorizes release of attorney-client report on city charter interpretation

After closed session the council directed staff by consensus to make available a confidential attorney-client report from LCW about the interpretation of city charter Article 28, section 3; no other action was taken in closed session.
The Oroville City Council returned from closed session on Jan. 21 and, at the meeting’s opening, asked the city attorney to report any action taken.
City Attorney David Ritchie told the council that, by consensus in closed session, the council had directed staff to obtain a confidential attorney-client privilege report from LCW concerning the interpretation of city charter Article 28, Section 3 and to waive privilege so the report can be made available to the public. Ritchie said no other action was taken during the closed session and that staff had given additional direction to city employees.
The council did not vote in open session on releasing the report; Ritchie’s statement described the council’s closed-session consensus and the intended release. No ordinance, contract, or formal public-record decision was made at that time. The city administrator indicated the report would be made available when appropriate.
