Council adopts resolution urging legal representation for immigrants facing ICE interactions

Philadelphia City Council on March 6, 2025, adopted Resolution No. 250171 recognizing the critical importance of legal representation for immigrants who may interact with Immigration and Customs Enforcement (ICE). The resolution encourages immigrant-serving organizations to promote legal resources and supports expansion of legal assistance for noncitizens at risk of detention or deportation.

Kate Parker, director of policy at the Defender Association of Philadelphia, testified in support and described the effect of representation: she said represented immigrants are more likely to remain with their families and to obtain relief compared with unrepresented individuals. "Representation matters," Parker told council, citing data the Defender Association provided about higher rates of relief for represented clients.

Council Member Dr. Nina Ahmad moved adoption of the resolution and noted Philadelphia’s history as a sanctuary city and the city’s interest in ensuring due process. Dr. Ahmad said legal representation is "not just a privilege. It is a fundamental issue of justice and due process." She and other council members cited partnerships with nonprofit legal providers and proposals to form or expand an immigration-defense unit in public defender offices as steps toward broader representation.

Public commenters also spoke for the resolution. Stanley Ellenberg, an immigration attorney and Eighth Ward council member, urged support for residents fearful of federal enforcement. The Defender Association and Philadelphia Legal Assistance highlighted existing hotlines and pro bono programs that assist low-income residents in housing and immigration matters.

Council adopted the resolution by voice vote after the motion and second; the chair declared the ayes had it. The resolution urges continued city support for legal services and increased public awareness of available immigration defense resources.
