SSRB extends bond deadline for 204 West Gardenia, orders permits and repair start dates

The Substantive Structures Review Board voted to extend deadlines for the property at 204 West Gardenia and ordered the owner to obtain permits and begin repairs under a revised schedule.

Counsel for the owner, Andres Garcia Moreno, told the board that the owner had submitted a structural engineer’s plan and had applied for a surety bond and that the documents were with the building department for review. "We did comply with the order ... and it has been submitted already with the building department," Moreno said.

Board members discussed deficiencies in the owner’s submission. One board member warned that a registered professional engineer’s design must be prepared prior to construction and said, "You're not gonna be able to get a permit without this." The member also pointed out that the inspection report identified deck removal and electrical work that were not covered in the contractor bids.

The board’s motion set several deadlines: the owner must submit a surety bond in the amount of $150,000 by March 15; if not posted, civil administrative penalties of $500 per day will begin March 16. The owner must obtain all necessary permits and complete repairs by April 15, 2025, and begin required demolition and/or repairs by April 21, 2025. The motion was seconded and carried.

Counsel for the owner said the owner had applied with local vendors for a bond and would update the bond amount to match the board’s requirement. Board members noted that the bond size was intended to ensure funds would be available if the city must remove the structure.
