County staff reported that an amended complaint in the eminent domain matter was to be filed and that the opposing party would have 14 days to object. Staff said that if both sides stipulate to the amendment, the process could be expedited; if the opposing party objects, the county would need to wait the 14-day period and could then seek an order for immediate occupancy. Staff advised that, assuming typical schedules and filings, it could be roughly 30 days before the county was in a position to break ground if an order for immediate occupancy is obtained.
A motion was made and seconded to go into closed session for litigation. Commissioners approved the motion by voice vote. Staff indicated a brief closed session was requested so commissioners and appropriate staff could discuss legal strategy and next steps with counsel.
