Committee advances lot-line adjustment after resident says neighbor is gifting 3 feet to resolve encroachment

A Middletown aldermen subcommittee voted to advance a subdivision request to formalize a three-foot transfer of land from 15 Mercer to 16 Warren after the owner at 16 Warren told the committee a sale-related survey found an encroachment.

Tyrone Diaz, who said he has lived at 16 Warren Street for about 21 years, told the committee his neighbor at 15 Mercer built a fence closer to the neighbor's property line and that the neighbor is transferring approximately 3 feet of land to resolve the encroachment. Diaz said he has an escrow agreement and is working with Warren Sussman to complete the paperwork.

Committee members asked whether all parties were satisfied and whether paperwork was in order. Several aldermen said the matter "sounds cut and dry" and that, provided documentation is complete, they were comfortable advancing the request. Alderman Ray seconded the motion to approve; a voice vote of "Aye" carried and the committee moved the item forward to a public hearing at the board's first meeting in April.
