Commission approves waiver, tax abatements and continuances; several items continued for more review

The Metropolitan Development Commission on March 5 handled multiple procedural and approval items: it waived a 12-month refiling restriction for a rezoning petition, approved two tax-abatement resolutions and multiple no-appeal petitions, and granted continuances on two zoning cases and an infrastructure-related petition. Staff also opened a bid for a Central State adaptive reuse RFP; one bid was received.

Waiver of 12-month refiling rule (2852 East County Line Road) The commission voted to waive its 12-month refiling rule for a rezoning petition at 2852 East County Line Road (case 2025 ZON016), allowing a new developer to file after a previous petition by another proposer had been defeated. Joe Calderon, attorney for the petitioner TWG Development, described the new project as focused on affordable housing and said tax-credit application timing created urgency. Staff recommended approval, noting the new proposal is substantially different from the previously denied self-storage request and that the CS zoning development statement effectively limited development without amendment.
