The Portland Fish Pier Authority on a special meeting approved a license allowing Bristol Seafood to install a concrete pad to support a compressor and authorized the board president to execute the agreement.
Kayla, a staff member, summarized the agreement and told the board it “will allow the installation of the pad,” contains language that releases the city and the pier authority from liability for damages, and gives the authority the right to revoke the license with 60 days’ notice.
The agreement also requires Bristol Seafood to restore the site if the authority cancels the license. “If we were to ask them to... cancel the license agreement, then they would be responsible for restoring it to its current similar condition,” Kayla said.
Board members discussed the revocation and restoration language during the meeting. Meredith moved to approve the license “substantially in the form attached to the agenda and authorize the president of the board to execute said license and any other documents necessary or appropriate to effectuate the intent of said agreement.” John Arnold seconded the motion. The vote recorded yes from Meredith (yes), John Arnold (yes), Mary (yes), Brandon (yes), Tracy (yes) and the presiding officer, Rob (yes); several members were absent. The motion carried.
The board did not take additional policy action at the meeting; members said legal staff had reviewed the language and the revocation and restoration provisions were intended to protect the authority if the installation later proved unsuitable.
The license approval and related materials were referenced under the meeting agenda; the board did not provide additional funding or change the footprint of existing leases in the motion.
