The draft uses definitions adapted from neighboring city codes and includes requirements that temporary vendors obtain a license, pay a fee, comply with health and safety codes and exhibit the license on request. The staff presenter recommended a placeholder license duration of 90 days; councilmembers noted other cities use 30 or 120 days and asked staff for a recommendation on an appropriate term and fee level.
Council discussion addressed common questions: whether delivery trucks that pass through the city are covered (reciprocity and delivery-only activity was distinguished from soliciting sales), how small or informal efforts (for example, neighborhood lemonade stands or a youth selling produce) would be treated, and whether the administrative process could be handled online.
Staff said an application is already feasible to create and that enforcement would be consistent with the current business license code. Council did not adopt any ordinance at the meeting; staff will prepare a revised draft with suggested fee, duration and enforcement language for a future meeting.
