Durham council unanimously approves permanent closure of Clegg Drive for proposed multifamily project

Durham City Council voted unanimously to permanently close Clegg Drive to allow recombination of the right-of-way with adjacent parcels for a proposed multifamily residential development and amended the comprehensive plan place-type map to designate the recombined parcels as Mixed Residential Neighborhood.
The action followed a staff presentation and brief questions from council. Jalisa Harris, staff planner in the Planning Department, told the council the request (street-closing case SC24000001) would reunify the former right-of-way with adjacent parcels so the applicant could develop a multifamily project. "The street closing request SC24000001 is for the permanent closure of the entirety of Clegg Drive to allow recombination of the right of way with adjacent parcels identified with RAIDs ... The applicant wishes to close the street to allow for the construction of a multifamily residential development," Harris said during the staff report.
The staff report noted the right-of-way currently contains only gravel driveways serving adjacent parcels and that there is no provision for a future connection to other streets. The staff presentation cited the state statutory findings the council must make before closing a street: that the closing is not contrary to the public interest and that no nearby property owner will be deprived of reasonable ingress or egress.
Matthew Carpenter, an attorney with Parker Poe representing the applicant, told the council the internal circulation for the project will be private: "the project is a multi family project, and so the internal streets will be private driveways and parking lots." He added the project must meet applicable build-to standards for the buildings that face public streets.
After brief discussion, the council approved two separate motions by unanimous vote: one to permanently close Clegg Drive and a second to amend the place-type map of the comprehensive plan to designate the recombined parcels as Mixed Residential Neighborhood. The clerk recorded the vote as 7-0 for both motions.
