Collin County Commissioners on Tuesday debated proposed amendments to interlocal agreements (ILAs) that would alter indemnification language governing law-enforcement services with smaller jurisdictions.
Commissioner David Webb said he could not support amendments that "surrender" the county's indemnification rights. "I just can't support it," Webb said, arguing the county has worked to preserve indemnity language to limit taxpayer exposure.
Nick Bristow, assistant chief deputy with the Collin County Sheriff's Office, told the court the sheriff's office will respond to child-crime reports in smaller jurisdictions regardless of the ILA and that the proposed language aligns with other ILAs the county has already approved. "This is the same language that's present in the Lucas, law enforcement ILA. This language is present in the Trinity Falls law enforcement ILA. This language is present in the Wylie Veil ILA," Bristow said.
A presenter identified in the record as Mr. Barnes explained the rationale for the change and and cited legal practice: "By law, separate from what the contract says, the law is. If a party has the duty to defend and indemnify another, the law gives them the authority to control the defense." He said the change is intended to treat contracting entities consistently and to reassure employees that the county stands behind its staff.
Commissioner Webb asked that staff provide a standard indemnification clause for future contracts. The presiding judge asked staff (identified in the record as Yoon and Russell) to develop uniform language and to work with Commissioner Webb on the matter. That request was recorded as a direction to staff; it is not recorded as a formal vote or contract amendment in the meeting minutes.
