FLVS general counsel schedules closed "litigation shade" meeting on Sept. 30 for federal appeal with K12, Inc.

David Daggetta, general counsel for Florida Virtual School, asked the trustees to "entertain a litigation shade meeting for purposes of the board's and legal counsel's discussion of litigation strategy and expenditures" related to "a federal lawsuit known as Florida Virtual School versus K12, Inc., currently pending in the United States Court of Appeals for the Eleventh Circuit and assigned to Pellop case number 24-10449-J," and said the meeting would occur upon or shortly after the Sept. 30, 2025 quarterly meeting.

Daggetta said the closed meeting would be held in compliance with the Florida statute he cited in the workshop and that "written public notice shall be provided in accordance with Florida law." He estimated the litigation shade meeting would last about 30 minutes, said the entire meeting "will be transcribed by a certified court reporter," and added that the transcript "shall be made part of the public record after the litigation is concluded pursuant to" the cited statute. He listed anticipated attendees who would be present as permitted by the statute: Board Chair Linda Reiter; Board Co-Chair Dr. Tony Arza; board members Erin Huntley, Rob Kornarens, Ed Pozzuoli, Nursey Ratcliffe and Dr. John Watcherat; CEO Dr. Louis Algaze; deputy general counsel Craig Beazer; General Counsel David Daggetta; outside counsel Thomas Bishop of the Bishop Page Law Firm; and the court reporter.

Daggetta returned the floor to the chair after delivering the notice and requested that staff provide the required written public notice and make logistical arrangements in accordance with the statute.
