The council recommended approval of a code amendment that would add language to Subsection 13.32.165(a) and 13.32.165(d)(1) of the Metropolitan Code of Laws to permit localized sidewalk-cafe design regulations in addition to the citywide sidewalk-cafe rules.
Matt Horace, identified in the meeting as the council liaison for the department, said the change does not substantially alter existing citywide requirements. Instead, it allows distinct zones — for example, parts of Second Avenue during reconstruction — to impose additional material or aesthetic requirements on sidewalk cafes while preserving the base regulations.
Horace said the proposal was led by downtown stakeholders and came through MDHA in connection with the Second Avenue redesign; the intent is to enable area-specific overlays that add requirements without rewriting the citywide rules.
A motion to recommend approval was seconded, and the measure passed with 7 votes in favor, 0 against, and 0 not voting.
The council chair closed the Government Operations & Regulations meeting after the vote.
