Palm Bay council adopts state-required change moving preliminary and final plat approvals to administrative process

Palm Bay City Council voted unanimously on June 16 to implement a state law that requires preliminary and final subdivision plats to be processed administratively rather than through public quasi-judicial hearings.
City staff said the changes are required by the amended Florida subdivision law and must be incorporated into the city code. The council approved Resolution 2025-25 designating the city manager (or designee) and the city surveyor (or designee) as the administrative authority, and passed Ordinance 2025-24 to amend the land development code. Both measures passed 5-0.
The changes remove the plat process from council public hearings and eliminate the city's 500-foot courtesy notice to neighboring property owners for plat approvals. Lisa Frazier, a city planning staff member, told the council the change is compelled by state statute and that "it is Bridal statute, that has been, signed by the the the governor at this point. And so we are legally compelled to make sure that our planning process is now administratively" processed.
Why it matters: proponents said the change brings local code into statutory compliance and clarifies which official must sign plats and performance bonds. Opponents, including several residents who spoke at the public hearing, said the switch reduces transparency and eliminates a long-standing local notice and comment step. Resident Bill Batten told the council, "Let's let the people that live within 500 feet be know knowledgeable of how the plat lays out," arguing that the public loses an opportunity to weigh in on details affecting nearby properties.
What staff said: City Manager Morton and the city attorney told council members that the state amendment (codified in the 2025 legislative chapter and reflected in Section 177.071 of the Florida Statutes) prescribes time frames and administrative procedures. Morton said staff recommends designating the city surveyor as the approving official and that the city will adjust bond and fee calculations and staffing to handle the workload.
Planning & zoning input: Planning and Zoning recommended approval with one condition: the administrative official should be a city employee (city surveyor or city manager designee), not an outside contractor. Several council members and the city attorney emphasized that the statutory process is tightly prescriptive and leaves limited local discretion about what must be included in a legal plat.
Council action and next steps: Council passed Resolution 2025-25 (designating administrative authority) and voted 5-0 to approve Ordinance 2025-24 on its first reading; a second reading will be scheduled to finalize the code change. Staff said they will also propose fee and budget adjustments in the coming cycle to account for additional staff and surveyor workload.
Resident concerns and staff's response: Multiple members of the public said the change amounts to a loss of local notice and urged city leaders to preserve pre-application or pre-submittal opportunities for neighbors. Staff and the planning board said earlier public notice and pre-application meetings are possible but are not required by the new statute; the board recommended keeping the administrative reviewer an in-house employee to preserve local familiarity and accountability.
The ordinance and resolution take effect as required by the statute; staff said July 1 (statutory effective date) is the driver for the timing of this code update.
