Council approves rezoning for 137-unit apartment project near Old Boonville Highway

The Evansville Common Council on July 14 approved an amended rezoning ordinance, R2025-15, allowing a proposed multifamily development of approximately 137 apartment units on a parcel north of Old Boonville Highway, west of Burkhart Road.
Cassie Virgin of the Area Plan Commission told the council the APC recommended approval conditioned on an updated UDC and noted the city’s 2035 future land use map recommends commercial use for the site. "The request to rezone this property to R-5 to allow the apartment complex would not be consistent with the comprehensive plan," Virgin said, but added that buffering, landscaping and traffic mitigation could lessen conflicts with adjacent single-family neighborhoods.
Kristin Lockyer, representing the petitioner, said the Fraternal Order of Eagles is selling the split parcel to a national partner to develop apartments and that the Eagles Lodge will remain. Lockyer described commitments in the amended UDC including tree buffers and fencing along the north and east property lines, a detention pond and walking trail, a dog park, completion of a traffic impact study per Evansville MPO and the city engineer, and sharing contact information with neighboring property owners. She said vehicular access to the new development would use the Eagles Lodge parking lot onto Old Boonville Highway rather than narrow neighborhood streets.
During the Area Plan Commission review, commissioners had sought development commitments similar to those previously required for a nearby rezoning. APC conditioned approval on a revised UDC; the applicant filed an amended UDC on July 8 with the listed provisions.
In the council roll call, eight members voted aye and one member abstained. Councilman Green announced he would abstain because he is a member of the Eagles. With eight ayes and one abstention, the council president declared Ordinance R2025-15 amended adopted.
