Cody council approves schedule change for Tree Streets waterline project; no cost increase

The City of Cody council on a unanimous voice vote approved Change Order No. 2 for the Tree Streets waterline replacement project Phase 1, moving the project's substantial completion date to Oct. 30, 2025, and scheduling final work roughly one month later in November 2025.
Staff member Philip Bowman told the council the change order "would only change the phase 1 project schedules" and that "there are no cost implications of this change order." He said the adjustment aligns Phase 1 and Phase 2 schedules because both phases are being performed by the same contractor, Wilson Brothers Construction.
Bowman said funding for the work remains in place through a combination of FY25 budget carryover and funds included in the FY26 budget, and that the city expects both phases to be completed later this year if the schedule alignment proceeds as planned.
Councilmembers asked about street repairs and impacts to school bus routing. Bowman said Eleventh Street, where much of Phase 1 work occurred, is planned for trench patching this season followed by a full overlay at the end of the overall project. He noted some remaining work in Casper Drive, nearby cul-de-sacs and Dale Drive, and that staff will coordinate with the school on schedule impacts.
Council discussion also referenced coordination with Black Hills Energy, which performed a gas-main replacement in Eleventh Street during the waterline work. Bowman said the utility work took longer than expected and contributed to the schedule shift but described the coordination as beneficial because it reduced the risk that a future gas-main replacement would later cut newly overlaid street surfaces.
A motion to approve Change Order No. 2 was moved by Council Member Satinari, seconded by Council Member Sweat, and carried by voice vote.
The council did not pursue liquidated-damages action at the meeting; Bowman and staff said they believe Wilson Brothers is making progress and are not recommending pursuing damages at this time.
