The City of Bangor Planning Board on July 1 unanimously approved a minor subdivision modification for a property at 1203 Broadway, dividing the existing roughly 8.1‑acre parcel into two lots of about 5.2 acres and 3.1 acres and conditioning approval on a city stormwater easement being finalized and recorded within 90 days of the board’s action.
The applicant’s representative, Sean Theiss, said the proposal is a simple lot split that keeps the existing strip‑mall on the larger lot and leaves the new 3.1‑acre parcel vacant. “Nothing’s proposed at this time for construction on the new lot,” Theiss told the board during the applicant presentation.
Board and staff review focused on technical compliance. Planning staff confirmed the application was complete and noted the project must meet the city’s minor‑subdivision requirements and state subdivision review standards under 30‑A M.R.S.A. §4404. City Engineer Jefferson Davis told the board the engineering office will prepare the easement language and handle recording: staff “will draft some easement language and get [it] over” to the applicant and the engineering office “will … record it,” the transcript shows.
The board made a series of findings required by the Land Development Code, including compliance with the minor‑subdivision standards in section 165‑126 and related code sections and state statutes cited in the staff packet. After voting through the code standards in sequence, the board voted on the final decision. The board’s motion granted a land development permit for a minor subdivision modification and a shoreland/slow‑to modification with the condition that the stormwater utility easement to the city be finalized with the city and recorded at the registry of deeds within 90 days of planning board approval. The decision passed unanimously.
The board’s approval endorses the subdivision plat so it may be recorded at the registry of deeds; staff noted fees had been paid and required report and plat materials were included in the project packet. No building or construction plans were presented for the new lot at the meeting.
The applicant may proceed with recording and any subsequent permitting steps required by city code and the engineering department.
