Council votes to support septic permit in drinking-water source protection zone, 3-1

The Nibley City Council voted to provide a letter of support for a proposed on-site septic system on an unincorporated parcel near 1575 E. Highway 101 after hearing a hydrogeologic assessment commissioned by the city.

Tom (public works) and consultant Bill Laughlin (Laughlin Water Associates) reviewed the study's findings in public: Laughlin concluded the proposed system's seepage was unlikely to reach the city's 640 well or the deactivated Gate Springs source because of the local geologic configuration and groundwater flow paths. Much of the seepage would, the study said, move toward the Blacksmiths Fork River rather than toward the two city sources.

Tom and Levi confirmed the city's code allows the council to consider a local letter of support for a septic permit within a source-protection zone if a hydrogeologic study and protective measures support the application.

After the presentation the council made a motion to sign a letter of support for the septic permit application; the motion passed (three in favor, one opposed on the record). Council discussion noted the city had paid for the hydrogeologic review and that the applicant reimbursed the study cost.

Why it matters: The council's support letter eases the applicant's path with the county and the health department but does not change the county's permitting authority. The decision reflects a technical finding that the proposed system presents low risk to Nibley's public water sources under current conditions.
