Councilmember Hernandez said one of the conditions attached to the project — an agreement on a day-labor site participation that the developer had previously accepted — had not been fulfilled. He asked for a short continuance to allow planning staff and the city attorney to review compliance and provide the council with a written basis for any action.
City staff told the council that part of the parcel-map process can be deemed approved by operation of law if the council does not act on a specific timeline. City attorneys were en route to the chamber to clarify whether the council could legally withhold recordation pending a determination on compliance.
After discussion, the council agreed to continue the item one day (to the next meeting) and requested the planning staff and the city attorney be present to document the status of the disputed condition and provide guidance on the council�s authority to record or not record the parcel map.
No final approval or denial of the parcel map occurred; the council requested written findings on compliance before taking substantive action at the subsequent meeting.
