Ogden Valley planning panel approves Fallow Refuge retreat with conditions, delays hard‑surface parking requirement

OGDEN VALLEY, Utah — The Ogden Valley Planning Commission on June 24 unanimously approved a conditional use permit for “Fallow Refuge,” a small meditation-and‑retreat operation proposed near Beaver Creek off Highway 39, but delayed enforcement of a code requirement that parking be paved.

The application, listed on the agenda as 2.1 CUP2024-13, would permit a year‑round conference/education center operation with a maximum on‑site capacity of 10 people, parking for 10 vehicles, three pedestrian bridges and two wells and septic systems. Planning staff told commissioners the Weber‑Morgan Health Department has provided conditional comments and listed two outstanding requirements for final health approval: installation of a replacement drain field with an alternating valve and submission of an engineered on‑site wastewater design. "What the health department required is a replacement drain field that must be installed with an alternating valve to allow for alternating flows," staff said during the presentation.

Planning staff presented site photos and the proposed layout and recommended approval subject to standard planning conditions and the health department requirements. The applicant, Mark Overvest, said each unit will include a small kitchenette, shower and toilet and described the project as a "very small, very intimate" year‑round retreat. "This would be a year‑round operation, max max capacity with 10 persons," Overvest told commissioners.

Commissioners focused their questions on utilities, river/stream setback compliance and parking surfaces. County code requires hard‑surfaced parking (asphalt or concrete) for year‑round commercial operations; the applicant proposed compacted aggregate/gravel for aesthetic and cost reasons. Planning staff advised that while approach drives can be compacted, the ordinance explicitly lists asphalt or concrete as acceptable hard surfaces for parking stalls. Commissioners discussed alternatives including asking the applicant to seek a variance from the Board of Adjustment or modifying permit conditions.

A motion to approve the conditional use permit carried unanimously after the commission approved staff conditions but excepted condition 8, which required the parking lot hard surface to be complete or escrowed before issuance. The approval thus allows work to proceed while the applicant pursues a variance or other remedy for parking surfacing. Chair Wampler called the vote: "All right. The motion passes unanimously."

The approval is conditioned on: meeting the Weber‑Morgan Health Department requirements for septic and well systems (the alternating valve/replacement drain field and an engineered on‑site wastewater design), obtaining any required access improvements and business licensure, and complying with other listed planning conditions. Staff noted that access improvements recommended by UDOT and the county’s traffic conditions must be complete or escrowed before a land‑use permit is issued unless otherwise arranged.

Commissioners and staff emphasized that final operation remains contingent on the health department’s written sign‑offs and on any required approvals if the applicant pursues a variance on parking surfacing. The commission’s action authorizes the use under county land‑use rules but does not release the project from achieving the technical and permitting milestones the health department and other agencies require.
