Leawood Board of Zoning Appeals — June 25, 2025: summary of actions taken by the board on cases with limited discussion.
- Case 24-2025 (3900 West 100th Terrace): The board approved a variance to allow conversion of a legally constructed deck to a three-season room where the lot’s irregular rear-yard averaging would otherwise require an additional 556 square feet in the rear yard. The applicant is Chi Nguyen; neighbors present spoke in favor. Outcome: approved.
- Case 25-2025 (9219 Cherokee Place): The board approved an exception to the side-yard setback to allow a 12-foot alignment where the existing structure sits about 11 feet from the north property line; the property is legal nonconforming. Applicant representation: Greg Schmidtberger, GS Engineering. Outcome: approved.
- Case 26-2025 (unplatted development / HF251333-3009): The board approved a variance to the front setback to allow a fire-department turnaround lane that will encroach about 3.33 feet from the front property line; planning commission had already approved a zoning deviation and staff said the lane will be gated/striped and include Knox Box access for fire apparatus. Applicant: Scott Slaughey and Doug Hoffman. Outcome: approved.
- Case 27-2025 (12322 Pawnee Lane): The board approved a fence-height exception to replace a deteriorating 4-foot fence with a 6-foot wood privacy fence; applicant Spencer Davidson said the change is to provide privacy and secure a planned hot tub. Outcome: approved.
- Case 28-2025 (13116 Granada Drive): The board approved a fence-height exception to replace an existing 5-foot wooden fence with a 6-foot wooden privacy fence along a busy arterial (Roe Avenue); the applicant said the existing panels are failing and noted a neighboring property has a 6-foot fence. Outcome: approved.
- Case 29-2025 (2512 West 90th Street): The board approved an exception to the side-yard setback to allow an addition to a house that is already nonconforming; the contractor, Jeff Shebeck, spoke for the homeowner. Outcome: approved.
Two cases received extended hearings and were denied: Case 23 (12609 Norwood Road) — variance denied after the board found the hardship criterion unmet — and Case 30 (Lee Boulevard) — variance to the maximum grade change denied 3–2 after neighbors raised stormwater and basement-flooding concerns.
All applicants will receive written notice from staff with next steps; several approvals require subsequent permits, final inspections, and standard plan or stormwater reviews before construction can proceed.
