The Sarpy County Board of Commissioners approved rezoning and platting for Milks Place, a two‑lot subdivision southeast of 120th Street and Mitchell Road, at its June 17 meeting.
Planning staff said the proposal would rezone roughly 14.36 acres from AG (Agricultural Farming District) to RE2 (Residential Estates 2 District) to create one 2.21‑acre residential lot (Lot 1) and an 11.86‑acre outlot for future transfer. The property contains an existing single‑family residence, outbuildings and a drainage way and creek that follow the western boundary of the parcel. The county planning director said the proposal was recommended for approval by the April 15 planning commission meeting and complies with the Sarpy County Comprehensive Plan under the family‑transfer exception to the 40‑acre build‑through overlay requirement.
The board voted on three separate but related items — rezoning, preliminary plat and final plat — and approved each by unanimous vote. Commissioners approved a short‑form subdivision agreement between the county and the John B. and Marilyn E. Milks Living Trust that sets conditions for recording and transfer.
The planning director and assessor noted several implementation points: the existing private well and septic systems do not require new permits under the request but the applicant must pay a single‑lot fee to the Sarpy County and Cities Wastewater Agency prior to the county signing the plat; the outlot will be required to meet a 3:1 plus 50‑foot drainage slope and a 50‑foot setback as part of future platting; and the final plat is approved subject to six conditions listed in the county packet.
Votes and movers were recorded on the public record: the rezoning motion passed on a motion by Commissioner Warren, seconded by Commissioner Burmeister; the preliminary and final plats also passed unanimously; the subdivision agreement passed on a motion by Commissioner Kelly, seconded by Commissioner Burmeister.
No members of the public spoke at the hearings. The Milks family appeared in the room but indicated a preference not to speak, and one commissioner offered personal remarks about the family during the meeting.
The approved actions allow the county to send required change‑of‑value notices to affected parties and to record the plat once the subdivision agreement conditions and applicable fees are satisfied.
