Polk County commissioners approved a petition Tuesday to vacate a portion of platted, unopened and unmaintained right-of-way shown on a 1919 plat of the Golden Ball Association's plat of home sites.
Real Estate Services staff said C. B. Myers III, as authorized agent for Lake Aurora Christian Assembly, LLC, requested the vacation to remove a bifurcating right-of-way and assemble the petitioner's property. During review, staff discovered part of Golden Ball Road lay outside the existing right-of-way; the petitioner agreed to convey additional right-of-way to the county. Staff reported that utilities and county divisions were contacted and raised no objections and recommended the board waive the petition fee, adopt the resolution vacating the specified portion and accept the quitclaim deed for the additional right-of-way.
A motion to approve carried by voice vote. The vacation will remove the public interest in the specified area and allow the petitioner to assemble adjacent parcels for more complete use of the property as described in the petition and resolution.
Staff remained available for questions during the public hearing; no members of the public spoke.
