Planning Commission certifies San Juan Oaks development agreement compliance after developer report

The Planning Commission certified that San Juan Oaks is in compliance with its development agreement after developers described construction progress, community improvements and conservation commitments.
Third Millennium Partners, represented by Michael Cady and Dustin Bogue, briefed the commission on the project’s status. The developers said they have progressed through grading and have partnered with Trilogy (a Shea Homes brand) as the builder for the active‑adult portion of the plan. Cady said the developer has recorded finished lots, pulled building permits and sold homes in phase 1: “We have pulled 83 permits for homes to date, and Trilogy has sold enclosed escrow on 60 homes,” he reported.
The developer also recounted public benefits contained in the development agreement. The project includes an on‑site conservation commitment of more than 1,200 acres to be held in conservation easement by San Benito Agricultural Land Trust, with Golden State Land Trust identified as an additional conservation easement holder for state wildlife permitting. Cady said the developer paid community benefit fees that grew from an original $5,559,000 to $6,059,000 after a first amendment to the agreement; staff records show that payment was made in February 2023.
Cady said the developer has invested in renovation of the public golf course and clubhouse, construction of on‑site parks (including a community garden and dog park), and dedication of public‑facing site improvements. Planning staff told the commission they have tracked conditions and conducted recurring biweekly meetings with the developer, and recommended adoption of a resolution certifying compliance.
Commissioner comments were limited. The commission voted 5-0 to adopt the staff resolution finding San Juan Oaks in compliance with its development agreement. The developer thanked staff for their oversight and said they would continue to coordinate on outstanding implementation matters.
The planning commission’s resolution will be forwarded to the Board of Supervisors as the formal record of the annual compliance review.
