The Board of Supervisors on Feb. 25 adopted a resolution and introduced an ordinance to implement Senate Bill 937's requirements that, for qualifying affordable housing projects, certain development impact fees be collected at building inspection or certificate of occupancy rather than at building-permit issuance.
County engineer Claudia Wade presented the item, explaining SB 937 took effect Jan. 1, 2025 and requires local agencies to allow timing of fee collection permissively for affordable housing to ease developer cash-flow constraints. The ordinance amendments listed chapters of the county code that set different development-fee provisions and would be revised to reflect the timing change for eligible affordable housing projects.
Staff asked the board to delegate authority to the deputy county executive for community services to create policies and administrative procedures to implement SB 937 locally and to direct staff to return with an analysis of whether the county should expand delayed fee collection to other residential projects (including an analysis of financial impacts on developer reimbursements and project schedules). The board approved the recommended actions unanimously.
