Council introduces ordinance to accept annexation of 7.753 acres at 1214 Stephenson Road

XENIA, Ohio — City Council on Feb. 27 introduced an ordinance to accept the annexation of 7.753 acres at 1214 Stephenson Road from Xenia Township into the city.

City staff said an extraterritorial service agreement approved Dec. 28, 2022 required the property owners to seek annexation as a condition of receiving city water service. The owners filed an annexation petition, and the Greene County Board of Commissioners approved the petition in December 2024. City staff cited Ohio Revised Code procedures requiring council action within 120 days after the record of annexation is received and recommended introduction of the ordinance.

Chief Stutes presented the staff report, explaining that the executed extraterritorial service agreement required the property owners to file for annexation and that the clerk of the county commissioners sent a certified record of the annexation proceedings as required by state law. Under ORC 709.04, staff said council had the option to accept or reject the annexation and that failure to act would be treated as a rejection under the statute.

Councilman Reynolds moved to introduce Ordinance 2025-03 to accept the annexation; the introduction was recorded without further questions. Staff noted that council would have up to 120 days from the certified record’s receipt to take final action.

Why it matters: Annexations change the city’s tax and service boundaries and bring property into the city’s zoning and service regimes; the annexation here was a contractual condition tied to providing city water service.

No formal final acceptance vote was recorded at the meeting; the ordinance was introduced for future consideration.
