TCEQ adopts amended occupational licensing rules, creates provisional licenses and delays fingerprint mandate

The Texas Commission on Environmental Quality on Feb. 27 adopted amendments to 30 TAC Chapter 30 to implement bills passed in the 88th Legislature, including provisions to create provisional licenses for Class D wastewater and public water system operators without a high‑school diploma, authorize issuance of digital licenses, and implement expedited application routes for military service members, veterans and spouses. Staff also withdrew a proposed rule requiring FBI fingerprinting as the only method to provide criminal history information to allow further stakeholder consultation.
Rebecca Morgan of the Occupational Licensing and Registration Division presented the rulemaking package, which implements House Bill 1845 (provisional licenses for Class D operators), HB 2453 (digital licenses), and Senate Bill 422 (requirements for applicants who are military service members, veterans, or spouses). Morgan and Deputy Director Haya Zeman explained that staff made substantive changes after public comment and withdrew the fingerprinting‑only requirement pending further evaluation.
Commissioner Katerina Gonzalez supported many provisions, especially the expedited licensing for veterans and military spouses, but expressed concern that a 30‑day statutory timeline for reciprocity could be difficult if other jurisdictions do not respond quickly. Staff and commissioners negotiated compromise language circulated during a brief recess; the commission adopted the package with those circulating changes, with authorization for staff to make non‑substantive edits required by Texas Register filing rules.
Jennifer Jamieson (representing OPEC in the record) expressed support for the rulemaking, and the commission approved the amended Chapter 30 with the circulated modifications on an aye vote. Commissioners asked staff to raise any implementation issues they encounter for future adjustments.
