TCEQ grants hearing for Wilson Springs Prairie on North Fork municipal utility district petition

The Texas Commission on Environmental Quality on Feb. 27 granted a hearing request from Wilson Springs Prairie LP and referred a petition filed by Ava Road and Rummell Road Farms, Ltd. to create the North Fork Municipal Utility District of Williamson County to the State Office of Administrative Hearings. The commission also referred the matter to its alternative dispute resolution program to run concurrently with the SOAH scheduling process.
Staff noted that Wilson Springs Prairie owns property adjacent to the proposed district and raised concerns about runoff from the proposed district, a statutory factor the commission must consider in district petitions. Based on adjacency and the runoff concern, staff and the commissioners concluded Wilson Springs Prairie demonstrated an interest distinct from the general public and granted its hearing request.
A motion to grant the request and refer the matter to SOAH and ADR passed on an aye vote. The referral initiates a contested‑case record to address statutory factors for new district formation and may include technical evidence on runoff and drainage.
